Validity reserves the right to change these Community Terms of Use from time to time at its sole discretion by posting updated terms to this website (or successor URL). These Community Terms of Use apply to all your visits to The Validity Community, both now and in the future.

  1. You'll need to log in to use the Validity Community. You agree that your profile name and any other personal information you choose to make public, together with your activity on the Validity Community, may be publicly displayed on your Validity Community account. You are responsible for setting your Validity Community account display settings to define your display settings, including regarding your public account name, and the level of public visibility of such information. You acknowledge that your access to and use of the Validity Community, including any personal information you submit to Validity while using it, is subject to the Validity Privacy Policy. You agree to notify Validity immediately of any unauthorized use of your account or any other breach of security.
  2. Usage Guidelines. While using the Community, you agree that you will be courteous and respectful of others, keep your posts relevant to the marketing and data industry and Validity’s products, services and programs, act responsibly to protect Validity’s, any third party's, your and your company's private and confidential information, and remember that it is possible that information appearing in the Community could be incorrect, incomplete, unclear, or misleading.
  3. You represent and warrant that: (i) you will comply with all applicable laws and regulations as you use The Validity Community; (ii) all information you have provided and will provide to Validity is true, correct, and complete in all respects; (iii) you will update Validity by email or other method as designated by Validity with any changes to information you have previously supplied; (iv) you have the legal right, power and authority to accept the terms and conditions of this Agreement on your own behalf and on behalf of any company that employs you or that you represent; and (i=v) any materials you provide, create or develop that are in any way related to this Agreement, or the use thereof, do not and will not infringe any Intellectual Property Rights of any third party. You must be at least 13 years old to participate in The Validity Community.
  4. You are not allowed to register multiple accounts. Any user found to be active under multiple identities will have one or more accounts suspended and their forum membership may be removed.
  5. Validity retains the right to remove content and limit users' access. Validity does not generally edit, monitor, or pre-screen content posted by users on The Validity Community. However, Validity retains the right, at its sole discretion, to limit any users’ access to The Validity Community and to remove material that, in Validity’ sole judgment, does not comply with these Community Terms of Use, or that is otherwise inappropriate, harmful, objectionable, or inaccurate. Moderators may take any action they deem necessary in their own judgment to support the Community Terms of Use. Such actions may include editing or deleting material and temporary or permanent banning of individual users in Validity’s sole discretion.
  6. Disclaimer of Warranties and Limitation of Liability. Users like you provide much of the material on the Validity Community. Such third-party content is the sole responsibility of the person originating the material. Validity does not control and is not responsible for this third-party material and you are responsible for the material you post on The Validity Community.  NO ORAL OR WRITTEN INFORMATION OR ADVICE GIVEN BY VALIDITY OR ITS AUTHORIZED REPRESENTATIVES SHALL CREATE A WARRANTY OR IN ANY WAY INCREASE THE SCOPE OF OUR OBLIGATIONS TO YOU. IN NO EVENT SHALL VALIDITY BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, PUNITIVE OR OTHER DAMAGES ARISING FROM YOUR USE OF THE VALIDITY COMMUNITY.
  7. Limited License. Validity hereby authorizes you to copy materials published by Validity on this website solely for non-commercial use within your organization in support of Validity services. No other use of the information is authorized. In consideration of this authorization, you agree that any copy of these materials which you make shall retain all copyright and other proprietary notices in the same form and manner as on the original. Except as specified above, nothing contained herein shall be construed as conferring by implication, or otherwise any license or right under any patent, trademark, copyright or any other intellectual property right of Validity or any third party.
  8. Content included on this site and provided by or on behalf of Validity (including but not limited to text, graphics, logos, images and forum posts) is the exclusive property of Validity. By submitting your content to the Validity Community you hereby grant to Validity a worldwide, perpetual, irrevocable, royalty-free and fully-paid, freely transferable, sub licensable (through multiple tiers) right to exercise all copyright, publicity, and moral rights, in any media now known or not currently known, with respect to any content you provide to us in any public space on this website or in any email that you provide to us through this website or any other Validity website. Please do not post content on the Validity Community if you do not want to grant Validity the abovementioned rights.
  9. The Validity Community may contain links to third party sites. Access to any other internet site linked to this website is at the user's own risk and Validity is not responsible for the accuracy or reliability of any information, data, opinions, advice or statements made on these sites. Validity provides these links merely as a convenience and the inclusion of such links does not imply an endorsement. Any links posted by you are subject to all Community Terms of Use like any other type of content posted to the Validity Community. You may not post a link that directs users to any content or information that would constitute a violation of these Community Terms of Use.
  10. The trademarks, logos, and service marks ("Marks") displayed within The Validity Community are the property of Validity or other third parties. Users are not permitted to use these Marks without the prior written consent of Validity or such third party which may own the Mark. "Validity" and all Validity product names are trademarks of Validity Inc.
  11. Trademark or Copyright Infringement Policy MailCharts respects intellectual property of others and we will investigate each notice of alleged trademark or copyright infringement that is provided to us. If you believe that your trademark or copyrighted work has been used or displayed in a way that constitutes infringement, please contact us at legal@validity.com with “Trademark Infringement” or “DMCA Takedown Request” (as applicable) in the subject line and please provide us with all of the following information: identification of the trademark or copyrighted work claimed to have been infringed; identification of the material that is claimed to be infringing and that is to be removed, and information reasonably sufficient to permit us to locate the material; your contact information, including your name, address, telephone number, and an email address; a statement by you that you have a good faith belief that use of the material in the manner complained of is not authorized by the trademark or copyright owner, its agent, or the law; and a statement that the information in the notification is accurate, and, under penalty of perjury, that you are authorized to act on behalf of the trademark or copyright owner; a physical or electronic signature of the IP owner (or a person authorized to act on their behalf)
  12. The Validity Cookie Policy is included in our Privacy Policy. You do not need to have cookies turned on to view forum postings. However, with cookies turned off (or if you do not accept cookie(s) from The Validity Community), you will not be permitted to sign in to The Validity Community to post content or respond to postings.
